Hello!
By confirming a reservation and/or making payment on this site, the user (hereinafter, the guest) declares that they have read, understood, and fully accepted these Accommodation Regulations and Terms . These terms are understood to be expressly and irrevocably accepted upon completion of the reservation and apply to the person making the reservation and all registered companions.
My story
1. Legal framework and nature of the service
Bük offers non-traditional short-stay accommodation (stays of 24 hours or more and less than one year) in apartments, studios, lofts and houses located mainly in Barrio Escalante and the metropolitan area of San José, Costa Rica. The activity falls within Law No. 9742, "Regulation of non-traditional lodging and tourism services through digital platforms", and within the regulations of the Costa Rican Tourism Board (ICT) and the Ministry of Finance applicable to this activity.
The properties may be located within condominiums governed by the Condominium Property Regulatory Law and by the Internal Regulations of each condominium. Those regulations — including the rules of coexistence, quiet hours and use of common areas — are binding on owners, tenants, invitees and guests, and form an integral part of these Terms. Likewise, the Guest undertakes to comply with the municipal regulations of San José regarding noise, public order and neighbourly coexistence.
2. Bookings: formation, confirmation and registration
2.1. A booking is considered confirmed only when payment has been successfully credited through the enabled method (PayPal). Until payment is credited, no dates are guaranteed.
2.2. Upon arrival, all guests must present valid official identification at the building reception for the security registration required by the condominium and by applicable regulations. The lead Guest is responsible for providing truthful and complete information; false, incomplete or impersonated information entitles Bük to cancel the booking without refund.
2.3. Minimum stay. Each property has a minimum stay (1 or 2 nights, as clearly indicated in the price and during the booking process). The system will not allow bookings below that minimum to be confirmed.
2.4. Maximum capacity. The number of guests may not exceed the maximum capacity published for each property. Unauthorised excess occupancy entitles Bük to deny entry or to terminate the stay without refund.
2.5. Hours. Check-in from 3:00 p.m. and check-out no later than 11:00 a.m., unless otherwise agreed in advance and in writing. Unauthorised late check-out may result in a charge for an additional night.
3. Erroneous or duplicate bookings — Limitation of liability and remedies
This clause is essential and has been accepted by the Guest upon booking.
3.1. Bük uses automated booking and payment systems and third-party technology providers (website platform, calendar, payment gateway). Despite the reasonable controls in place, the Guest acknowledges and accepts that situations may occur unintentionally, such as: duplicate bookings, double bookings or overbooking of the same unit for overlapping dates, errors in dates, material or manifest errors in the published price, technical failures, service interruptions, delays or inconsistencies attributable to the platform, to the payment gateway or to third parties outside the control of Bük.
3.2. Sole and exclusive remedy. In any of the above cases, or in the event of supervening impossibility of honouring a booking already paid for, the only obligation of Bük towards the Guest, at the sole choice of Bük, shall be one of the following:
- (a) Relocation: to offer the Guest alternative accommodation of equal or higher category, within the same zone or area (Barrio Escalante / metropolitan San José), for the same dates or equivalent dates, at no additional cost to the Guest; or
- (b) Refund: to reimburse the Guest the amount actually paid, in full or pro rata as applicable, through the same payment method used.
Either of these remedies, once offered and carried out, fully and definitively extinguishes any claim by the Guest arising from the erroneous, duplicate or unhonoured booking.
3.3. Limitation of liability. To the maximum extent permitted by law, the total liability of Bük towards the Guest, for any cause and under any theory of liability, shall in no case exceed the amount actually paid for the affected booking. Bük shall not be liable for indirect, incidental, punitive or consequential damages, nor for loss of profit, loss of opportunity, nor for expenses of third parties contracted by the Guest (flights, transfers, tours, penalties, related bookings, lost time or disruption of plans), even if Bük had been advised of the possibility of such damages.
3.4. Bük does not warrant that the platform or the payment gateway are free of errors or available without interruption, and assumes no liability for failures, declined charges, duplicate charges originated by the payment provider, nor for charges generated by the Guest through retries. Verified duplicate charges will be refunded in accordance with point 3.2(b).
4. Payments, currency and invoicing
4.1. Prices are expressed and charged in United States dollars (USD). The nightly price is shown on each property; the total is calculated by multiplying the nightly rate by the number of nights selected, respecting the minimum stay.
4.2. Payment is processed online through PayPal. The booking is confirmed only when payment is successfully credited.
4.3. Bük will issue the corresponding electronic receipt in accordance with Costa Rican tax regulations. Any applicable tax will be governed by the legislation in force.
5. Cancellation and refund policy
5.1. Cancellation by the Guest: unless a different condition is stated on the property, cancellation is free of charge up to 48 hours before the check-in time; after that period, the booking is non-refundable.
5.2. Refunds: where a refund applies, it will be made through the same payment method, within the operating timeframes of the payment provider. Crediting times depend on the provider and on the issuing institution of the Guest.
5.3. Cancellation by Bük: if Bük must cancel for reasons beyond its control or due to force majeure, the remedy in point 3.2 will apply (equivalent relocation or refund), with no additional liability.
6. Rules of coexistence and condominium regulations
In addition to these Terms, the Guest undertakes to comply with the Internal Regulations of the condominium where the property is located. In particular:
6.1. Quiet hours and noise. The rest hours defined by each condominium must be respected (usually from 10:00 p.m. to 7:00 a.m.). Noise, loud music or disturbances that disturb neighbours or other condominium owners are prohibited. Barrio Escalante is a residential and gastronomic area with particular sensitivity to noise; non-compliance may lead to intervention by the condominium administration, the Ministry of Health or the Municipality of San José.
6.2. Parties and events prohibited. Parties, celebrations, large gatherings or any use other than accommodation are not permitted.
6.3. Visitors. Entry of unregistered persons is not permitted. Only guests previously registered on the booking may access the building. The condominium may prevent access by unauthorised third parties.
6.4. Common areas and parking. The use of common areas (pool, gym, terraces and similar) is subject to the condominium regulations and to availability. Parking, where it exists, may be subject to availability and to an additional cost that must be arranged in advance.
6.5. Coexistence. The Guest undertakes to behave respectfully towards neighbours, staff and other guests, and not to carry out activities that disturb the peace, safety or order of the property or the condominium.
7. Prohibitions and responsible use of the property
7.1. Smoking is prohibited inside the accommodation and in areas where the condominium restricts it. Breaking this rule incurs a deep-cleaning charge.
7.2. The use, possession or distribution of illicit substances is prohibited, as is any illegal activity, unauthorised commercial activity or activity that puts safety at risk.
7.3. Subletting, assigning or reselling the booking is prohibited, as is using the property for purposes other than the contracted accommodation.
7.4. Pets. Admitted only with prior written authorisation from Bük and from the condominium; otherwise they are not permitted.
8. Damage, Guest liability and security
8.1. The Guest is responsible for any damage, loss or theft caused to the property, its furnishings, equipment or the common areas during the stay, whether by the Guest or by their companions. Bük may charge the cost of repair, replacement or extraordinary cleaning.
8.2. Bük may require a security deposit or a hold authorisation depending on the property, which will be released after verifying the condition of the property at the end of the stay.
8.3. Access may be by smart lock or by keys; the Guest must safeguard them and follow the entry instructions. Loss of keys or devices may incur a replacement charge.
8.4. Bük is not responsible for valuables, money or belongings left in the property or in the common areas.
9. Force majeure
Bük shall not be liable for breaches or delays arising from causes beyond its reasonable control, including natural disasters, utility outages, internet or technology provider failures, orders from the authorities, civil unrest, pandemics or other events of force majeure or fortuitous event. In such cases the remedy in point 3.2 will apply where appropriate.
10. Personal data
The data provided by the Guest is processed for the purpose of managing the booking, the security registration and the accommodation relationship, in accordance with Costa Rican data protection legislation. It is not shared with third parties except as necessary to provide the service or as required by law.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Costa Rica. Any dispute shall be submitted to the competent courts of Costa Rica, without prejudice to any amicable resolution mechanisms the parties may agree in advance.
12. Acceptance
By confirming the booking and making payment, the Guest declares that they know and fully accept these Accommodation Rules and Terms, including expressly clause 3 (Erroneous or duplicate bookings — Limitation of liability and remedies).
13. Language of the Terms
These Terms and Conditions are executed in Spanish. The English version published on this site is a courtesy translation, provided solely to aid understanding. In the event of any discrepancy, doubt or conflict of interpretation between the two versions, the Spanish version shall prevail.
